DePuy ASR Lawsuit Update: Rottenstein Law Group LLP Responds to J&J $3 Billion Settlement Report

Johnson & Johnson is reportedly considering a more than $3 billion DePuy ASR hip implant settlement, according to Bloomberg.* The Rottenstein Law Group LLP, a metal-on-metal hip implant firm, comments on the news and notes that DePuy hip settlements could amount to more than $300,000 per plaintiff.

There are more than 8,000 DePuy ASR lawsuits pending in federal court alone, according to Bloomberg. Johnson & Johnson said in the story it wants to resolve all federal and state cases by early next year. In 2010 Johnson & Johnson recalled 93,000 metal-on-metal hip implants worldwide, about 37,000 of those in the United States, the story said. The ASR had a failure rate of 12 percent after five years.

“There are a handful of ASR bellwether trials coming up this fall and winter,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “It will be interesting to see how they affect this proposed settlement. Ultimately, though, this is a good sign for those looking to file DePuy lawsuits. There is the potential to receive certain compensation for harms suffered as a result of the alleged side effects of the device.”
